But when Spears was a no-show, Kaplan decided to start without her, taking testimony from the singer's former assistant Alli Sims and ex-manager Larry Rudolph, among others. Sims and Rudolph were both served subpoenas by Kaplan earlier this year Kaplan hopes to determine whether Spears drinks alcohol or uses drugs in front of her young children.

KEVIN FEDERLINE's attorney has started depositions in his client's ongoing custody trial without BRITNEY SPEARS - after the pop star failed to show up at his offices on time. The tardy Toxic singer was expected to give her deposition under oath at the Los Angeles offices of attorney Mark Vincent Kaplan at 10am on today.
